Terms and Conditions

Please read these Terms and Conditions carefully before using the services offered by ShipMyCar US ("Company," "we," "us," or "our"). By accessing our website or using our auto transport services, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Services Overview

ShipMyCar US is an auto transport broker that connects customers with licensed, DOT-registered motor carriers for the purpose of shipping vehicles within the United States. We are not a carrier ourselves — we arrange transportation through our network of vetted carrier partners. Our FMCSA Broker Authority MC number is available upon request.

2. Quote and Pricing

2.1 Quote Validity

All quotes provided by ShipMyCar US are estimates based on current market conditions, fuel prices, route availability, and vehicle specifications. Quotes are valid for 7 days from the date of issuance. Market conditions can change, and final pricing may vary.

2.2 Price Adjustments

The final price may differ from the initial quote due to:

  • Inaccurate vehicle information (size, weight, operational condition)
  • Changes in pickup or delivery location
  • Remote or restricted access locations requiring additional services
  • Significant fluctuations in fuel costs
  • Changes in requested ship dates
  • Expedited service requests added after initial booking

2.3 Additional Fees

Non-running vehicles, oversized vehicles, or vehicles with modifications may incur additional fees. Storage fees may apply if a vehicle cannot be picked up or delivered as scheduled due to the customer's unavailability.

3. Booking and Deposit

3.1 Order Placement

An order is confirmed when you provide written or electronic acceptance of our quote and pay any required deposit. By placing an order, you represent that you are the legal owner of the vehicle or have the owner's authorization to arrange its transport.

3.2 Deposit and Payment

A deposit may be required to secure your booking. The remaining balance is typically due upon vehicle pickup or delivery (cash, certified check, or approved electronic payment — no personal checks). Specific payment terms will be detailed in your order confirmation.

4. Pickup and Delivery

4.1 Pickup Window

Your specified "first available date" is the earliest date your vehicle can be picked up — not a guaranteed pickup date. Actual pickup typically occurs within 1–5 business days of your first available date, depending on carrier availability and route demand.

4.2 Door-to-Door Service

We offer door-to-door transport whenever safely and legally possible. Due to low-clearance bridges, narrow streets, weight restrictions, or local ordinances, carriers may need to arrange a nearby meeting point. The carrier will communicate any such requirements in advance.

4.3 Vehicle Condition at Pickup

Upon pickup, the carrier will complete a Bill of Lading (BOL) documenting the vehicle's condition. You or your authorized representative must:

  • Be present at pickup and delivery (or designate a representative)
  • Sign the BOL at both pickup and delivery
  • Remove all personal items from the vehicle (prohibited by FMCSA regulations)
  • Ensure the gas tank is no more than ¼ full
  • Disable or remove toll transponders, parking passes, and alarms
  • Document any pre-existing damage on the BOL before signing

5. Insurance and Liability

5.1 Carrier Insurance

All carriers in our network are required to maintain minimum cargo insurance coverage as mandated by the FMCSA. Coverage amounts vary by carrier. Proof of carrier insurance is available upon request before booking.

5.2 Damage Claims

Any damage must be noted on the Bill of Lading at delivery before signing. Signing a clean BOL constitutes acceptance of the vehicle in the described condition and may limit or void your ability to file a damage claim. Damage claims should be filed directly with the carrier's insurance. We will assist you in the claims process.

5.3 Broker Limitation of Liability

As a broker, ShipMyCar US is not responsible for physical damage to vehicles during transport. Our liability is limited to facilitating the carrier-customer relationship and assisting with dispute resolution. Our maximum liability to you shall not exceed the broker fee paid for the service.

5.4 Excluded Items

We are not liable for damage to or loss of personal items left in the vehicle, nor for damage resulting from pre-existing conditions, mechanical failure, or items extending beyond the vehicle's standard profile (spoilers, racks, etc.) that were not disclosed at booking.

6. Cancellation Policy

6.1 Customer Cancellations

  • More than 24 hours before scheduled pickup: Full refund of any deposit paid
  • Less than 24 hours before scheduled pickup: Deposit may be forfeited
  • After carrier has been dispatched: Cancellation fees of up to $150 may apply

6.2 Company Cancellations

We reserve the right to cancel an order if no suitable carrier can be found within a reasonable timeframe. In such cases, a full refund of any deposit will be issued. We will provide reasonable notice and assist in alternative arrangements where possible.

7. Transit Times

Estimated transit times are provided as guidelines based on distance and typical carrier schedules. They are not guaranteed. Delays may occur due to weather, mechanical issues, regulatory inspections, or other unforeseen circumstances. We are not liable for losses resulting from delivery delays.

8. Customer Responsibilities

You agree to:

  • Provide accurate and complete vehicle and contact information
  • Ensure someone is available to release and receive the vehicle
  • Maintain valid auto insurance on your vehicle during transport
  • Not load the vehicle with any illegal substances or hazardous materials
  • Comply with carrier instructions regarding vehicle preparation
  • Respond promptly to communications from us or the assigned carrier

9. Prohibited Vehicles and Items

We cannot transport:

  • Vehicles exceeding carrier weight or dimension limits without prior arrangement
  • Vehicles containing firearms, explosives, or illegal substances
  • Vehicles with leaking fluids or other conditions posing a safety hazard
  • Personal property left inside vehicles (items may be removed by carrier)

10. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of ShipMyCar US or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on our website.

12. Limitation of Liability

To the fullest extent permitted by law, ShipMyCar US and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United States and the state in which our principal place of business is located, without regard to conflict of law principles. Any disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association. Class action waiver: you agree to bring disputes only in your individual capacity.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the new Terms. We recommend reviewing this page periodically.
